Now that the House of Representatives has sent a criminal referral to the Justice Department holding former Trump adviser Steve Bannon in contempt of Congress, the ball is now firmly in the court of Attorney General Merrick Garland, who has to decide whether or not he will enforced the referral and have Bannon arrested and put in jail until he complies with a subpoena from the Jan. 6 Select Committee.

Will Garland have Bannon arrested and jailed? That was the question put to MSNBC legal analyst Katie Phang, who was asked by host Tiffany Cross on Saturday morning:

“How is it that Steve Bannon has the privilege to negotiate if he might want to come and testify?”

Phang replied:

“Well, to your point, there really shouldn’t be more than one standard because the law should be blind and apply uniformly no matter who you are, race, gender, creed or color. In this particular instance, if you’re a Republican, you should have joined your nine brethren in voting to support this referral to the DOJ for the contempt proceedings against Bannon because what’s good for the goose is good for the gander and in the event — the very slim, I’m hoping — event that perhaps Republicans take over, you’d want to enforce your opinions if you’re the seat of power.”

However, Phang added that she predicts Bannon will soon be in a world of hurt:

“But I believe there’s going to be a cooked Bannon goose very soon because the DOJ, in its efforts to uniformly apply the law, will, attempt to indict. Why? because it was a duly-authorized issued subpoena and Bannon ignored it and there must be consequences if you’re going to ignore a duly-issued authorized subpoena.”

The legal expert also noted that Bannon doesn’t have a leg to stand on, no matter what defense he tries to raise:

“But what’s the defense that’s going to be raised by Steve Bannon?” she elaborated. “Once he’s indicted by the United States Attorney for the District of Columbia, he’s going to raise the defense of executive privilege, which is a very rarely navigated political concept.

“If you do governmental misconduct or there’s a crime, you don’t get that protection and there’s definitely crime here.”

Hopefully, an arrest warrant will be issued for Bannon next week and we can all watch as the does the perp walk of shame.
