If Americans want to codify abortion rights and protect them from the Supreme Court, Rep. Mondaire Jones (D-N.Y) shared a plan on MSNBC that should motivate voters to keep Congress in Democratic control.

Women are now second-class citizens because of the right-wing judges on the Supreme Court. Roe v Wade protected a woman’s right to choose but nearly fifty years after the original 7-3 ruling, a 5-4 ruling overturned it just weeks ago. Many red states have since enacted trigger laws banning abortion, including in Ohio where a 10-year-old rape victim was denied the procedure, and Republicans apparently have no problem with that at all.

So now the question is how can we reverse the Supreme Court? Well, one way would be to expand the court by increasing the number of judges on the bench from 9 to 13 or maybe more. Democrats have already authored such a bill. Then the court could reverse the overturn.

Congress could also pass a bill codifying abortion rights, which Democrats have also tried to do. Unfortunately, Republicans in the Senate are blocking the legislation from moving forward with the help of two conservative Democrats: Senators Joe Manchin (D-W.V.) and Kirsten Sinema (D-Ariz.), both of whom oppose getting rid of the filibuster.

Of course, the easy fix for this would be to elect more Democrats to the Senate. Replacing Manchin and Sinema with progressive candidates would also be a plus. But even if Democrats have a firm majority to pass the bill through Congress, the Supreme Court will just strike it down anyway, at least under the current 6-3 makeup. But Jones, a Harvard Law graduate, presented a plan that would cut the high court out of the process altogether.

What he proposes is to literally include language in the Women’s Health Protection Act barring the Supreme Court from being able to review its constitutionality.

“We have seen that this Supreme Court majority, this far-right majority is hostile to democracy itself,” Jones said. “If we are to vote on the Women’s Health Protection Act for the second time this term, I am pushing to include a provision to deprive the Supreme Court of review of that statute. There is precedent for this, it has been done before, and it is a practice that has been upheld before. We know that most of the cases the Supreme Court decides, it is only able to decide because of the jurisdiction that Congress has explicitly legislated it to have. The Constitution is very narrow in terms of the scope of jurisdiction that it grants to the Supreme Court. We have tools at our disposal here.”

So, there is a plan to make abortion rights the law of the land. The key is to make sure Democrats have an iron grip on control of Congress after the 2022 Election, including in the Senate. Then Democrats can kill the filibuster, expand the Supreme Court, and codify abortion rights while preventing the Supreme Court from reviewing the law. If Americans are serious about reversing the damage done by this court, they need to vote in November as if their liberty and lives depend on it, because they do.
