In response to the FBI executing a search warrant at Donald Trump’s Mar-a-Lago home on Monday, GOP state Rep. Anthony Sabatini (R-Fla.) called on the Florida state legislature to declare war on the FBI and all federal agencies.

The FBI conducted a legal search and seizure on Tuesday to reportedly find and recover classified documents that Trump illegally stole when he left the White House in January 2021. In fact, the National Archives referred Trump to the Justice Department in February over the missing materials. Stealing official documents violates the Presidential Records Act, and if Trump sold classified information to another country such as Russia, it’s a violation of the Espionage Act. Either way, Trump would be breaking the law.

Republicans have been complaining about the search, especially since Trump himself released a statement crying about it, but the FBI had a warrant signed by a federal judge, and obtaining a warrant to search a former president’s home would have required significant evidence to justify it.

Despite these facts, and the fact that Republicans have frequently claimed to back law enforcement and claim to be the “law and order” party, they have repeatedly attacked and threatened the FBI and the DOJ.

And now Trump-loving Florida GOP state Rep. Anthony Sabatini wants the Florida legislature to “sever all ties” to federal agencies and make it legal for state law enforcement to arrest federal agents “on sight.”

Of course, state law enforcement has no such power. Federal agents have jurisdiction across the country. As long as they are not violating state laws, they cannot be arrested, especially if they are serving and executing a federal search warrant. Trump is not above the law. Neither he nor Sabatini can expect the state of Florida to be an impenetrable fortress that protects Trump from being held accountable for crimes he has committed. That would make the state a fiefdom that no longer deserves the protection of the United States Constitution and government. What Sabatini is demanding sounds like secession, which should disqualify him from public office.

Sabatini’s demand once again demonstrates that Republicans are seemingly becoming fascists. They would seek to weaponize the DOJ and FBI to persecute their political opponents but oppose being held legitimately accountable for their very real crimes according to their own words.
