Senator Marco Rubio (R-Fla.) is not at all bothered by Donald Trump being in possession of highly classified and top secret documents that he’s not supposed to have, even minimizing the seriousness of the scandal by claiming it’s an issue of “storage.”

Trump is currently under investigation for violating the Espionage Act and Presidential Records Act after the FBI served a search warrant at Mar-a-Lago to recover boxes of documents Trump refused to turn over in compliance with a subpoena earlier this year.

Republicans have desperately tried to defend Trump by attacking the FBI and the Justice Department. They’ve also attempted to excuse Trump’s crimes in a number of ways that do not hold water. And Rubio did the same over the weekend during an interview in which he claimed the DOJ is merely upset about how Trump stored the documents and not whether he should have access to them.

“This is, really, at its core, a storage argument that they’re making,” Rubio falsely claimed. “I don’t think a fight over storage of documents is worthy of what they’ve done, which is [a] full-scale raid and then these constant leaks.”

He went on to say that investigators “don’t deny that he should have access to those documents.”

The law makes it clear that Trump is not supposed to possess any of these documents even if he did manage to declassify them, which he didn’t. Keeping them is a violation of the Presidential Records Act, which requires every former president to hand over all documents to the National Archives. Even former President Barack Obama had to follow the law.

The DOJ also gave Trump a generous amount of time to turn over the documents he stole. You can bet Rubio and other Republicans would be calling for the death penalty right now if a Democrat had illegally taken classified documents from the White House and stored them at their private residence. But Republicans think the law doesn’t apply to them. Trump is a threat to national security and so is every Republican who defends him or makes excuses for him.
